They can grant the work permit anyway in "exceptional circumstances" i.e. if the player is considered to have exceptional potential etc. In practice, it just means that there's enough of a grey area the big clubs can circumnavigate the rules i.e. "If Liverpool etc. are interested then he must be good" while the smaller clubs can't.
